In hindsight, I know it should have been written, but it was a verbal agreement, do I have to move today (the last day) or do I have to be terminated 30 days in advance, provided I pay next month`s rent? It would not be easier to enter into a written lease. You don`t need to design one, and you don`t need an expensive lawyer (despite popular beliefs), there are already plenty of resources available. There are hundreds of online sites that offer rental models – just download one and fill it out as a normal form. Written contracts are there to protect both landlords and tenants. I would interview all tenants or landlords who would continue with a rental agreement without a written contract. I think it sounds the alarm. A tenant without a written contract is always entitled to all legal rights of an ordinary tenant under contract, including water, heating, safe environment, etc. Similarly, the tenant is still required to pay the rent without notice and to take proper care of the property. The rights provided by law still stand in the way of the rights stated in a written or oral agreement.

An agreement that indicates that you or your landlord has fewer rights than those given under common law or law is a fictitious lease. Unfortunately, as a tenant, you have very few rights in law. Your landlord can use “your” room if you are not there and you can distribute with reasonable notice – probably a month in your case. You can move your belongings as long as they make sure they are not damaged. After about a month or two, my dog was chased away on the grounds that he had vomited on the carpet. When this accident occurred, I informed my owner/roommate (because it was both) of what was going on, and I went to buy cleaning equipment and cleaned the carpet myself, and I took pictures that showed no visible alteration after shampooing. There are obligations that you and your landlord have that are not stipulated in the contract, but are set by law and are incorporated into all leases. These terms are part of the contract, even if they have not been explicitly agreed between you and your landlord.

It doesn`t matter what the tenant said. Don`t even bother to justify it or “examine it.” Print a copy of the written rental agreement, give it with written notification of the rent increase. If you want to be nice (I like to be nice), then tell them that you can only go through a written agreement, and ask them if they intend to stay or resign to move.
